Terms and Conditions for Maskan IQ Application
Welcome to Maskan IQ, a mobile and web application owned by Smart Plus Company for buying, selling, and renting real estate properties. By using our application, you agree to the following terms and conditions:
- Eligibility: You must be at least 18 years of age to use our application. If you are under 18 years of age, you must have the consent of your parent or legal guardian.
- Account Registration: You must register for an account to use our application. You agree to provide accurate and complete information during the registration process. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
- Listings and Transactions: Our application allows users to list properties for sale, purchase, or rent. We do not verify the accuracy of the listings and we are not responsible for any errors or omissions in the listings. We do not guarantee the availability or quality of the properties listed on our application.
- User Conduct: You agree to use our application for lawful purposes only. You agree not to use our application to:a. violate any applicable laws, regulations, or ordinances;b. infringe upon the rights of others;
c. transmit or distribute any viruses, malware, or other harmful code;
d. interfere with or disrupt the operation of our application;
e. engage in any activity that is harmful, offensive, or abusive;
f. collect or store personal information of other users without their consent.
- Intellectual Property: Our application and all content on our application, including but not limited to text, graphics, images, logos, and software, are the property of Smart Plus Company or its licensors. You agree not to reproduce, distribute, modify, or create derivative works based on our content without our prior written consent.
- Disclaimers: Our application is provided on an “as is” and “as available” basis without any warranties, express or implied. We do not guarantee the accuracy, completeness, or timeliness of the information on our application. We are not responsible for any errors, omissions, or interruptions in the operation of our application. We are not responsible for any damages, including but not limited to, direct, indirect, incidental, consequential, or punitive damages, arising from the use or inability to use our application.
- Indemnification: You agree to indemnify, defend, and hold harmless Smart Plus Company and its affiliates, officers, directors, employees, and agents from any and all claims, damages, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising from your use of our application or your violation of these terms and conditions.
- Governing Law and Jurisdiction: These terms and conditions are governed by and construed in accordance with the laws of the State of California, without giving effect to any principles of conflicts of law. You agree to submit to the exclusive jurisdiction of the state and federal courts located in the County of Los Angeles, California.
- Modification: We reserve the right to modify or update these terms and conditions at any time. Any changes will be effective immediately upon posting on our application. Your continued use of our application after the posting of any changes constitutes your acceptance of the modified terms and conditions.
- Termination: We reserve the right to terminate your account and/or access to our application at any time for any reason, without notice.
